Please read these Terms and Conditions (the “T&C”) carefully before using Our Service.
Definitions
For the purpose of the T&C, the following terms shall have the following meaning, whether they appear in singular or in plural:

“Application” means the software program provided by the Bank, downloaded by You on any Device, named AM Bank Application.

“Account” means a unique account created for You to access Our Service or parts of Our Service.

“Bank” (referred to as either "Bank", "We", "Us" or "Our" in this Agreement) refers to AM Bank sal (Bank Number 101 in the List of Banks at the Central Bank of Lebanon).

“Country” refers to the Republic of Lebanon.

“Content” refers to material including without limitation; Your personal information, information related to the Account, transactions, instructions, content, text, messages, images, files, photographs, drawings, descriptions, audio material, video material, audio-visual material or other information that You may, for whatever purpose, post, upload, submit, email, transmit or otherwise link or make available to and through the Service, alone or as part of other works, in any form, media or technology whether currently known or hereafter developed.

“Device” means any device that can access the Service such as a computer, a mobile phone or a digital tablet, etc. ...

“Service” refers to the Website and/or Application.

“T&C” means these Terms and Conditions regarding Your use of the Service.

“Website” refers to AM Bank sal’s website https://www.ambank.com, and any future website which the Bank may have.

“You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
Acknowledgment

These are the T&C governing the use of this Service which You must abide by, in addition to any other agreements, requests or undertakings signed by You at the Bank.

The T&C set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with the T&C.

By accessing or using the Service You agree to be bound by the T&C. If You disagree with any part of the T&C then You may not access the Service.
Account

When You create an account with Us, You must provide Us information that is accurate, complete, true and current at all times. Failure to do so constitutes a breach of the T&C, which may result in immediate termination of Your account on Our Service.

The Bank, at its sole discretion, reserves the right to validate the information You provide the Bank, and to require additional information from time to time, in compliance with applicable laws, rules, and regulations.

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service. We will treat any transactions made under Your password as being authorized by You.

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

You may not use as a username i.e. the name of another person or entity, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

You agree that the Bank shall not be liable and You agree to indemnify the Bank, its stockholders, directors, officers, employees, and representatives for any losses, damages or costs the Bank incurs for acting in accordance with or based on requests/instructions received through the Service, which the Bank believes to have emanated from You.
Authorized Usage of the Service

You commit to only use the Service in a lawful and goodwill manner. You choose the services and products that best meet Your requirements. You have the responsibility to keep Your information and transactions private and secure. It is Your sole responsibility to monitor and control access to and use of Your Account. You are aware that occasionally repairs, updates and maintenance on Our systems means that some or all of the Service may not be available or may be temporarily slow. We may immediately (either temporarily or permanently) suspend, restrict or stop Your use of the Service. You are responsible and liable for all activity on Your Account. You must not use the Service in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the Terms and Conditions (T&C), or act fraudulently or maliciously. The Service may be utilized at any time except for when it is unavailable due to instances such as planned and/or unplanned system maintenance, telecommunication, electrical, network disruptions, and other analogous reasons. The Bank may modify or discontinue any portion of the Service at any time, and from time to time, without notice to You. The Bank has the right to set commissions for the use of the Service.

You must ensure that any instructions, information and/or data You submit using Your Account are correct. You are responsible for any losses You suffer if the instructions, information and/or data You submit are incorrect. You shall not use, or misuse the Service in any way which may damage or harm any functionality of the Service or the ability of any other user to use the Service or any of its’ functionalities. You shall not attempt to gain unauthorized access to any materials other than those to which are publicly available or available within Your Account.
Your Right to Post Content

Our Service may allow You to post Content. You are responsible for the Content that You post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, You grant Us the right and license to use, modify, delete, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of Your rights to any Content You submit, post or display on or through the Service and You are responsible for protecting those rights. You agree that this license includes the right for Us to make Your Content available to other users of the Service, who may also use Your Content subject to the T&C.

You represent and warrant that: (i) the Content is Yours (You own it) or You have the right to use it and grant Us the rights and license as provided in the T&C, and (ii) the submission or posting or displaying of Your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

You acknowledge and consent that We may disclose any of Your Content: (1) in compliance with local, national, and international laws or rules or regulations, and (2) to protect You against fraud.
Content

The Bank is not responsible for the Content of the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under Your Account, whether done by You or any third person using Your Account.

You may not upload, transmit, or input any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, (i) unlawful or promoting unlawful activity, (ii) defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups, (iii) spam, machine – or randomly – generated, constituting unauthorized or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling, (iv) containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person, (v) infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity or other rights. (vi) impersonating any person or entity including the Bank and its employees or representatives, (vii) violating the privacy of any third person, (viii) false or fraudulent information and features.

The Bank reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with the T&C, refuse or remove this Content. The Bank further reserves the right to make formatting and edits, and change the manner of any Content. The Bank can also limit or revoke Your use of the Service if You post such objectionable Content. As the Bank cannot control all Content posted by users and/or third parties on the Service, You agree to use the Service at Your own risk.
Restrictions

You agree that You shall not, directly or indirectly, under any circumstance and through whichever means, perform any of the following actions:

Republish, sell, rent, lease, transfer, recirculate, redistribute, edit or otherwise modify the Service or make available or otherwise provide access to the Service for any third party, or any portion thereof or data thereon.

Reproduce, duplicate, copy, photocopy, print, display or otherwise exploit all or any part of the Service, for commercial purposes and for non-commercial purposes whether electronically, mechanically or otherwise, in any form and for any reason whatsoever.

Translate, transmit, distribute, reduce to any electronic medium or machine-readable form, or otherwise make available in any form or by any means all or any part of the Service or any information or materials retrieved from the Service, including, without limitation, graphics and logos, in whole or in part, for any purpose whatsoever.

Conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to the Service without the Bank’s prior express written consent.

Use the Service or any business listings, or other Content, to promote another business or commercial venture.

Create compilations or derivative works of the Service or its content.

Use the Service for the benefit of any third party except as specifically contemplated under the T&C.

Alter, decompile or reverse engineer any software component of the Service.

Use the Service to post, upload, transmit, convey, submit, distribute, store, destroy or link to another user’s Content, Content: (a) that contains any viruses, Trojan horses, worms, time bombs, cancel bots or other computer programming routines that are intended to interrupt, damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, software or hardware or telecommunications equipment, or data or personal information; (b) that is false, misleading or inaccurate in any way; or (c) in violation of any acceptable use policy or other policy posted in the Service from time to time.

Interfere with, damage, disable, disrupt, impair or gain unauthorized access to the Service including the Bank’s servers and networks.

Send or cause to send unsolicited bulk messages (also known as "spamming") or other unsolicited bulk communications of any kind or chain letters through the Service.

Use the Service in any way which is unlawful, illegal, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent or harmful, invasive of another's privacy and rights, tortious, or otherwise violates the Bank’s rules or policies or in connection with any such purpose or activity.

Use the Content or any other materials from the Service in any manner that may infringe upon any copyright, intellectual property right, proprietary right, property right, patent, trademark, trade secret, privacy or any other rights, of the Bank or any third party.

Use the Service and/or any communications service, chat room, message board, blog, forum, newsgroup, or other interactive service that may be available to You on or through the Service to transmit, upload, post, distribute or facilitate distribution of, or otherwise make available any information or content, including text, communications, software, images, sounds, data or other information, that: (1) is false, or (2) contains explicit or graphic descriptions or accounts of sexual acts, including, without limitation, sexual language of a violent or threatening nature directed at another individual or group of individuals, or (3) includes any inside information and/or proprietary or confidential information learned or disclosed under nondisclosure agreements, or (4) You are restricted from using under any law, or (5) contains software viruses or any other computer code, files or programs that are designed or intended to disrupt, damage, or limit the functions of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any other party.

Attempt, facilitate or encourage others to do any of the foregoing.
Content Backups

Although regular backups of Content are performed, the Bank does not guarantee there will be no loss or corruption of data.

Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.

The Bank will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But You acknowledge that the Bank has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.

You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.
Intellectual Property
Unless otherwise stated, the Service and its original content (excluding Content provided by You or other users), components, features and functionality are and will remain the exclusive property of the Bank and/or its licensors. The Service is protected by copyright, trademark, patent, trade secret, and other laws of both the Country and foreign countries. All intellectual property rights are reserved. Our trademarks and trade dress may not be used in connection with any product or service without the prior written explicit consent of the Bank. You may not copy, adapt, reproduce, disassemble, reverse engineer, translate, decompile, decode, modify or create derivative works from or exploit the Service and its components, publish, transmit, distribute, display or modify in any way, in whole or in part, any of its contents or related software. All worldwide rights, titles and interests in the Service including their respective components and contents, belong exclusively to the Bank. Any violation of this clause automatically grants the Bank the right to terminate all Your rights to the Service.
Intellectual Property Infringement
We respect the intellectual property rights of others. You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any Content is infringing Your copyright.
Your Feedback to Us
You may send feedback including innovations or suggestions regarding the attributes, performance or features of Our Service. You assign to the Bank all rights, title and interest in any feedback You provide the Bank. If for any reason such assignment is ineffective, You agree to grant the Bank a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such feedback without restriction.
Links to Other Websites
Our Service may contain, for convenience only, links to third-party web sites or services that are not owned or controlled by the Bank. The Bank has no control over, and assumes no responsibility for, and neither endorses nor approves the content, privacy policies, availability, or practices of any third party web sites or services. You further acknowledge and agree that the Bank shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services. When You engage with a third party website, You are at Your own risk interacting with the third party, not with AM Bank sal. You are responsible to take any protective measures to guard against viruses and other destructive elements. We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.
Termination

You acknowledge that the Bank shall be entitled, in its absolute discretion, at any time, and without prior notice or liability and for any reason whatsoever, to suspend, restrict and/or terminate Your Account, Your access and use of the Service immediately, including without limitation if You breach the T&C. Upon suspension or termination, Your right to use the Service will cease immediately.

If You wish to terminate Your Account, You may simply discontinue using the Service.

The suspension or termination of Your benefit from the Service shall not prejudice Your liability and the application of the T&C in respect of things done or omitted to be done through the Service prior to suspension or termination thereof.

The T&C shall be deemed to remain in full force and effect if and in so far as any transaction is completed but not debited to Your Account prior to suspension or termination of Your benefit from the Service. Such suspension or termination shall not affect/eliminate the Bank's right to debit the amounts payable by You for the Service rendered from Your Account or any other accounts.

The Bank shall not be responsible for the return to You of any of Your Content of any kind upon any termination or suspension of Your access to the Service, including without limitation any information input into the Service which You had performed.

You agree that the Bank, its stockholders, directors, officers, employees, and representatives shall not be liable to You or any third party for any modification or suspension or termination of the Service, or suspension or termination of Your access to the Service.

The Bank does not guarantee the continuous availability of all banking products or services mentioned in this Agreement. The Bank reserves the right to suspend or terminate, in its sole discretion, any and all of the services or products or features in the Service, at any time with or without cause.

Any termination of Your Account or Your access and use of the Service (howsoever occasioned) shall not affect any accrued rights or liabilities of either parties nor shall it affect the coming into force or the continuance in force of any provision hereof which is expressly or by implication intended to come into or continue in force on or after such termination. Without prejudice to the generality of the aforesaid, the obligations under clauses: Links to Other Websites, Disclosure of Information, Limitation of Liability, Intellectual Property Infringement, Intellectual Property, "AS IS" and "AS AVAILABLE" Disclaimer, and Indemnity shall survive the termination of the T&C.
Limitation of Liability

You irrevocably agree and confirm that the Bank, its stockholders, directors, officers, employees, representatives, suppliers, and its affiliated companies shall in no event be liable to You or any third party for any claims, losses, damages, costs and expenses of whatever kind or nature (legal or otherwise including all lawyers’ fees) and howsoever arising whether in contract, tort, negligence, strict liability, breach of statutory duty or any other basis, including without limitation, direct or indirect, special, incidental, exemplary, consequential or punitive damages, or business, goodwill, opportunity, privacy, time, profit or data or savings losses, incurred by You and howsoever caused whether directly or indirectly in connection with the T&C, the Service, any access or usage or interruption or delay or failure of the Service, or Your reliance on or use or inability to use the information, materials, products and services on the Service including but not limited to the following circumstances, even if We have been advised of the possibility of such losses and damages and even if the remedy fails of its essential purpose;

Bank enforcing its rights according to the T&C.

Your access or use or the inability to access or use the Service (or any third-party link to or from the Service) for whatever reason.

If You are not receiving communication from Us including the cases when You change Your mobile number and fail to inform Us and/or You change Your address and fail to inform Us, and all other cases when it is clearly understood that You committed a default in notification towards Us.

Your disclosure of any information according to the T&C.

Any instruction, communication or operation made by You, or purportedly made by You and referable to a compromised username and password of Your Account, and which was processed by Us prior to or at the time of such cancellation, or which We were unable to stop the processing of.

Any failure by Us to carry out any instruction referable to a compromised username and password of Your Account, which was outstanding as at the time We cancel such compromised username and password of Your Account, and/or which We had stopped the processing of.

Your reliance on the information contained within the Service.

Any material downloaded or otherwise obtained in connection with the Service.

Any technical, hardware, software, telecommunications, server or connection failure of any kind.

Any loss or corruption of any data, database or software.

Any interruption, error, omission, delay in operation, computer viruses, or otherwise.

Any circumstance suffered by You as a result of any prohibition, restriction, delay in use or access of the Service due to any Lebanese regulation or any other country regulation.

Fraudulent access or utilization of the Service, damage or corruption of any Device, hardware or software You use with the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of the T&C.

The disclosure of information concerning Your Accounts and/or transactions with the Bank to unauthorized persons for any reason whatsoever, including but not limited to wiretapping of communication lines or erroneous connection by telecommunication switches, or errors in transmitted information due to faulty lines, and any and all forms of high technology surveillance or fraud.

Errors, breakdown or failure of third-party systems which the Bank is connected to or used by the Bank in providing the Service.

Any error(s) in transmission of instructions that might have been transmitted through the Service or transmission by the Bank of any other data or information through the Service.
Indemnity
You hereby agree to indemnify and undertake to keep indemnified the Bank, its employees, officers, affiliated companies and subcontractors and their respective officers, agents, partners and employees, from and against all liabilities, claims, damages, losses, costs, and expenses, including without limitation legal expenses, attorneys' fees, and any amounts paid by the Bank to a third party in settlement of a claim or dispute, on a full indemnity basis, that may be incurred or suffered by the Bank in connection with or arising from (1) Your use or misuse of the Service, or (2) Your breach of the T&C howsoever occasioned, or (3) any claim that You committed a breach to the T&C, or (4) any intellectual property right or proprietary right infringement claim made by a third party against the Bank in connection with Your access and use of the Service, or (5) any of Your Content that was posted or otherwise submitted on, through or in connection with the Service.
"AS IS" and "AS AVAILABLE" Disclaimer

The Service and its content are provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Bank, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, representations or endorsements of any kind, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Bank provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Bank nor any of the Bank’s providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted, timely, secure or error-free or that any identified defect will be corrected, or that there will be no delays, failures, errors or loss of transmitted information; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service and the material, information and content provided by third parties and/or functions therein; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Bank are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components or other invasive or damaging codes, that is for any reason whatsoever whether within or outside Our control.

You agree that the Bank shall not be liable for any damages arising from any of the circumstances mentioned herein.

You have the sole responsibility for adequate protection and back up of data and/or equipment and for undertaking reasonable and appropriate precautions to scan for computer viruses or other destructive properties.
Severability

If any provision of the T&C is determined to be invalid, illegal, or unenforceable pursuant to applicable law or any court order or other competent authority, then the invalid and unenforceable provision shall be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the other provisions of the T&C shall continue in full force and effect or, at the Bank’s sole discretion, such provision may be severed from this Agreement and the remaining provisions of this Agreement shall remain in full force and effect

Any rights not expressly granted herein are reserved.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under the T&C shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
Third Party Content
We are not liable towards any party in relation to the correctness or accuracy of any third-party content which the Service may contain and/or provide access to.
Bank’s Records

You acknowledge and consent that the Bank’s records and any records of instructions, communication, and operation relating to Your access and usage of the Service and any record of any of Your instruction, communication, and operation received by the Bank or by any relevant person authorized by the Bank relating to or connected with the Service shall be binding and conclusive on You for all purposes whatsoever and shall be conclusive evidence of the transactions, instructions, communication, and operation as though such instructions, communication, and operation, were written documents.

You hereby agree that all such records are admissible in evidence and that You shall not challenge or dispute the validity, admissibility, reliability, accuracy or the authenticity of the contents of such records merely on the basis that such records were incorporated and/or set out in electronic form or were produced by or are the output of a computer system, and hereby waive all of Your rights (if any) to so object. You hereby waive any such right You may have at law.
Disclosure of Information

You irrevocably consent to the Bank’ disclosure to any third party, of any information pertaining to You, Your Account, transactions’ details, and records in any manner and to such extent as the Bank may at its sole and absolute discretion deem fit in order to fulfill the Bank’s obligations hereunder and/or in compliance with the law or with the order of any court or government or regulatory authority according to all the applicable local, national, and international laws or rules or regulations. Thereby You irrevocably release the Bank from the banking secrecy obligation in regards to the provisions of the T&C.

You acknowledge and agree that the Bank does not warrant the security of the information transmitted using the Service and You hereby accept the risk that any information transmitted or received using the Service may be accessed by unauthorized third parties.
Assignment
The Bank may transfer, sub-contract or otherwise deal with the Bank’s rights and/or obligations under the T&C without notifying You or obtaining Your consent. You may not transfer, sub-contract or otherwise deal with Your rights and/or obligations under the T&C.
Governing Law
The laws of the Country “Lebanon” shall govern the T&C, and Your use of the Service. Your use of the Application may also be subject to other local, national, or international laws.
Disputes Resolution
If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Bank.
Agreement
The T&C is an integral part of all other contracts and documents that You may have signed and may sign with and at the Bank including but not limited to the General Agreement.

Amendments to the T&C
We reserve the right, at Our sole discretion, to modify or amend the T&C at any time. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised and amended terms. If You do not agree to the new terms, in whole or in part, please stop using the Service.
By continuing to access or use Our Service, You acknowledge that You have read, understood, and fully agree with AM Bank sal’s Terms and Conditions and Your agreement shall have the same legal validity and enforceability as a manually executed signature or use of a paper-based record-keeping system to the fullest extent permitted by applicable law.
